Original Abstract

Cílem příspěvku je hodnotit užívání pojmu "cenný papír" v odborných ekonomických textech v kontextu nedávné rekodifikace soukromého práva. Příspěvek porovnává význam pojmu v oblasti financí s jeho legální definicí a dále se zabývá pojmy "zaknihovaný cenný papír" a "investiční nástroj".

English abstract

The aim of this paper is to evaluate the use of the term "security" in professional economic texts in terms of recent private law recodification. The paper compares the extent to which the understanding of the concept of "security" in the area of finance matches with its legal definition, which has changed considerably in relatively recent recodification of civil law. It also discusses the relation of this concept with the concept of "investment instrument".
