The content of the course is to introduce students to the field of public law. Students will be gradually introduced to the different branches of public law, namely constitutional, criminal, administrative, construction, trade and tax law, including their interrelations.

Learning outcomes of the course unit

Students will know the theoretical background and the resulting positive legal regulation. They will acquire the institutes of public law, which is the subject of focus. They will be able to understand the legal standards in terms of their systematic arrangement, they will understand the basic legal terminology and will be able to use legal terminology in the application necessary publiclaw standards as in other related legal and economic subjects and in their future professional practice.

Students must be aware of basic legal concepts.

Planned learning activities and teaching methods

Lectures consist of an explanation of basic principles, methodology of the discipline, problems and their solutions.

Assesment methods and criteria linked to learning outcomes

No credit is given.
The examination is in the form of a written test. The test consists of closed questions. Knowledge of the material covered is tested. Classification is carried out in accordance with the directive of the Faculty of Business at the BUT. A minimum of 50% of the points is required to pass the examination. Participation in the examination is compulsory.

Course curriculum

1. Základy ústavního práva - Ústava, subjekty ústavního práva, ústavněprávní vztahy, stabilita a dynamismus ústavy
2. Listina základních práv a svobod - základní práva a svobody, nezadatelnost, nezcizitelnost, nepromlčitelnost, nezrušitelnost, Schengenský prostor
3. Trestní právo, trestní zákoník - trestný čin, retroaktivita, trestní odpovědnost, skutková podstata TČ, pachatel
4. Trestní právo, trestní řád - trestní řízení, presumpce neviny, osoby činné v trestním řízení, vina a trest, hlavní líčení, důkaz, vazba
5. Přestupky - přestupek, sankce, blokové řízení, příkazní řízení
6. Správní řád - správní řízení, podání, lhůta, správní orgán, doručování, rozhodnutí, exekuce
7. Přezkum správních rozhodnutí, právo na informace - odvolání, rozklad, obnova řízení, autoremedura, přezkumné řízení, právo na informace
8. Soudní přezkum správních rozhodnutí - správní žaloba, kasační stížnost, kasační princip
9. Stavební zákon - územní řízení, stavební řízení, územní rozhodnutí, územní souhlas, územní plánování, kolaudační souhlas
10. Katastr nemovitostí - nemovitá věc, parcela, pozemek, evidence v katastru nemovitostí
11. Živnostenské podnikání - vázaná, koncesovaná a volná živnost, provozovna, odpovědný zástupce
12. Daňový systém a daňové právo - daň, konstrukční prvky daně, plátce, poplatník
13. Daňový řád - daňové řízení, vyměření daně, doměření daně

Aims

The aim of the course is to familiarize students with the systematics and individual branches of public law. Students will be gradually introduced to the basic institutes of constitutional, criminal and administrative law, including misdemeanour law, building law and tax regulations. Upon completion of the course, the student should be able to navigate these branches and solve basic problems.
